The key is just that - they are a reseller of the car - so unless they signed an agreement when they bought the car to promote the exact content and wording of the original declaration made by the selling manufacturer - they have no obligation past a "For Sale As Is" notice - and unless they imply that the car IS street legal, all they need is note that the car is NOT street legal.

the ebay ad said that there may be ways of registering it; which by implication is suggesting that it is street legal. Additionally, the ebay ad never said it wasn't street legal. Even after the seller was told as such, he refused to change the contents.
