The thing that story clearly leaves out.. and I think might be mean theres more to the story then told... is how if at all the officer knew the guy was gay? The article is written to connect the gay with the hiv belief, but nowhere does it state thats why the guy had hiv. The guy didnt have hiv and you cant get hiv from cpr(Though you can get other nasty diseases obviously), but thats a slightly less nationally sensational story then guy doesnt help gay man. Aka its a poorly trained police officer that prolly still needs to go to jail but it shouldnt be in naitonal news.

Although - had the man been HIV positive, and the friend had contracted HIV from blood contamination or whatever, wouldn't the same people be lining up to sue because the policeman (if he knew) did NOT prevent exposure?
Kind of damned if you do.. and damned if you don't.
However that's not the case here - but just pointing out the other possible out come...

I have a Bronze Lifesaving Cross and throughout my training, I was always taught the golden rule of self-preservation. In this case, the police chief felt it dangerous to perform CPR, and decided then and there that he should protect the living people first, by eliminating the risk of HIV/disease contraction. The policeman was right to block CPR, and cannot be sued. If there was no protective equipment, there would have been a slight chance of blood to blood contact whilst performing expired air resuscitation.
Discrimination laws cannot apply because it is extremely risky to perform CPR on anyone, due to the risk of contracting infectious diseases. I certainly would not have performed EAR on the man - I would have gotten his friend to do that part of CPR, provided he knew for sure that Green didn't have any infectious diseases. The police chief probably over-reacted, but better safe than sorry. The police chief did not contribute to the man's death, because he was dead anyway.
