Gates said a vehicle owner would hear noise coming from the vehicle well before the upper ball joint failed. Mechanics also will find out if an upper ball joint needs to be repaired during routine maintenance, Gates said.
yeah....most low paid techs working for lower end manufacturers won't even look at that during routine maintence. Unless they are behind on hours for the week and want to dig up some warranty work.

my step dad called his dealer on the fact that they didn't notice his tires were worn down after they did an oil service on his Ram. whats to make us think that they will notice the ball joints loose

Gates said if the upper ball joint fails, it is most likely to happen at low speeds and during turns.
ever hear of a freeway on/offramp? those can be taken at some high speeds, and i don't know of too many ramps that are a straight shot onto the freeway.
a balljoint doesn't care what speed the car is going. it's going to come apart of it's bad. end of story, and hopefully not someone's life.

Chrysler needs to stop going by AxBxC=X<cost of recall=no recall (Fight Club quote, but it is true) and just issue the recall.
